It would seem as though are French friends were at it again. This time I think that they definately went to far though. As the dust is settling it would appear that the "B" sample is not even Landis sample it has some how mysteriously be mixed up and that codes on the container don not match. THIS OF COURSE IS BECAUSE IT WAS TAMPERED WITH! As for his positive "A" sample only one in four tests of that sample resulted in a positive and this positive result seems to be representitive of a poor test procedure by those wonderful sceintists at our favorite Frence lab! It would seem as though poor Floyd was wrongly draged through MUD of the cycling world. Can you say lawsuit!!! Anyone who knows the cycling world knows that now no mater how well vindicated Floyd is there will always be those who think he cheated the system somehow! Some will always label him a "Doper". This is unfortunate because the story never made sense testosterone just does not work for any short term results. I read a couple theories online about blood bag mix ups and these were really the only theories that made sense in terms of why and how he would have doped! Again it would now seem that he will be exonerated as he should be! I can once again say that I watch and was inspired by the greatest Tour De France comeback of all time! Thanks Floyd!

I haven't seen any news on this, but was told that there was a problem with the test about a month a go.

I was told by a reliable source that the test were all screwed up. This was about a month ago and I am relatively sure that I posted something about it.
I am now curious if this is the case. If he is found guilty then so be it if not then let's move on.
Why can't the rest of the world be moderate and un-biased and let's see what happens???

This is why due process is in place, and why it sucks that due process was violated in this case. EVERYBODY heard that Flyod was "guilty". Nobody heard that, "Oh BTW, the lab screwed the tests up." Now, Floyd's team is disbanded, he's fired and his reputation destroyed.

Landis camp files motion for dismissal
Late Monday, Floyd Landis' attorney Howard Jacobs submitted a motion for dismissal of Landis' case to the United States Anti-Doping Agency (USADA) Independent Anti-Doping Review Board.
According to a statement from Jacobs, the motion focuses on problems with the tests that showed Landis as positive for exogenous testosterone after stage 17 of this year's Tour de France. In particular, the Landis camp alleges flaws in the carbon isotope ratio test which allegedly proves that Landis' elevated testosterone:epitestosterone is caused by exogenous testosterone.
Jacobs's submission alleges that:
"WADA's own protocols require that all testosterone metabolite differentials provide clear evidence of testosterone usage to find an athlete positive. Given the data, three of the four testosterone metabolite differentials tested in Landis' sample are reported as negative considering the margin of error.
The only testosterone metabolite that can be argued as positive under the WADA Positivity Criteria resulted from an unknown laboratory error and is not the result of testosterone usage.
The one metabolite that has been identified by WADA-accredited laboratories as the best, and longest-term indicator, of exogenous testosterone usage was reported as negative in Landis' urine samples."
Jacobs argues that "the single [positive] T/E [Testosterone/Epitestosterone] analysis in this case is replete with fundamental, gross errors. These errors include inconsistent testosterone and epitestosterone levels from testing on the 'A' sample as well as multiple mismatched sample code numbers that do not belong to Landis. In the case of the mismatched sample identification codes, the alleged confirmed T/E data on the 'B' sample is from a sample number that was not assigned to Landis. The differences in sample identification numbers also point to issues in the chain of custody of the Landis sample.
"Clinical laboratories making these types of gross errors could easily find themselves answering to a wrongful death lawsuit, and often do," said Jacobs. "At a minimum, those laboratory errors must go to the defense of the athlete and must result in a finding that the T/E results are wholly unreliable."

I have also concluded that rarely do opinions change before,during or after the debate.
I have also concluded that most people are biased due to political affiliation,national origin loyalities or general prejudice with or against an individual or group of individuals.
Whether they will admit it or not.
To conclude I am sure that someone will disagree with my conclusions.

I have concluded that there is not one thing that people will NOT debate and argue about.

I was simply posting info with my own spin. It does seem that Floyd was sold down the river by the cycling community though. From Day one the whole testosterone thing has not made sense! It would not do anything for him short term. I have never gotten beyond that!!! That is why i couldn't believe he would have "Doped" using testosterone had it been EPO I probably would have immediately believed he was guilty. Anyway...

Landis didn't challenge the B sample.
If the sample identity numbers were askew, why didn't he challenge the B sample result?
By not challenging he has let two months go by - with his reputation lying in tatters.
That's of course if this "new information" is true.
if it's true now - it must have been true back then.
Also it's my recollection that the opening and testing of the B sample was done in the presence of Landis lawyer too.

Unless the lawyers knew at the time the numbers didn't match and kept it in their back pocket so they COULD challenge the results later.

LIt's hardly in the best interests of their client to allow speculation about his guilt/innocence to continue for two months if they had evidence that could have exonerated him.Financially,this has caused Landis enormous damage.If his lawyers had been able to clear his name that damage would not have occurred.
Withholding that evidence would amount to professional misconduct.

I thought that I just read recently that the results of the B test were not released to Landis and his lawyers until just a few days, maybe a week ago? I'd have to search around for it, but I seem to remember that they were quite upset that it had taken so long.

Oh yawn... even if he gets off due to lab stuffups, which I see is all bs anyway, that does not exonterate landis... it just means he gets off on a technicality...
he's still as guilty as sin...
